Update No. 1 from the Administrator
October 23, 2026
To the unit owners of the condominium corporations under administration.
This is my first update as Administrator. It covers my role, my priorities and the work done so far. I will send further updates as the work progresses.
1. My role
On October 15, 2026, the Ontario Superior Court of Justice made an Order under section 131 of the Condominium Act, 1998 appointing me as administrator of 24 condominium corporations. On October 22, 2026, the court made a further Order adding three more condominium corporations. There are now 27 corporations under administration. They are listed at the end of this update (section 13) and in Appendix 1 to the October 15 Order.
Paragraph 2 of the October 15 Order states:
"THIS COURT ORDERS that Brian Antman be and is hereby appointed as the administrator (the "Administrator") under section 131 of the Condo Act over each of the condominium corporations listed in Appendix "1" hereto (the "Subject Condo Corps")."
Paragraph 5 states:
"THIS COURT ORDERS that the respective boards of directors of each of the Subject Condo Corps be and are hereby disbanded until further order."
The former boards no longer have any authority. Until the court orders otherwise, I hold all of the powers and duties of the board of directors of each corporation under the Act and under each corporation's declaration and by-laws (paragraph 3 of the Order). The Order also requires me to call owner meetings to elect a "Shadow Board" for each corporation within 30 days. Section 9 below explains what that means.
I act for the corporations. I do not act for individual owners and cannot give individual legal, tax or insurance advice. Where this update says something is "not in the scope of the Administrator," the decision is yours to make, and you may wish to get your own advice.
2. Priorities
My priorities in these first weeks are to:
- keep each building insured;
- keep heat, water and other essential services running;
- put licensed property management in place;
- respond to municipal orders on safety and repairs;
- collect the records needed to run the corporations and hold elections; and
- hold the Shadow Board elections required by the Order.
These come first because they protect the safety of residents and the value of the buildings. They also prepare each corporation to return to self-governance.
3. Insurance
Three kinds of insurance apply in the buildings.
Building insurance. The corporation insures the building and the common elements, as required by the Act and each corporation's declaration.
The building policies for seven corporations were due to expire on October 22, 2026: the six Kipps Lane corporations in London (MSCC 505, 506, 507 and 508 and MCC 353 and 357) and Niagara South Standard Condominium Corporation No. 145.
I have negotiated with the insurer, and they have agreed in writing to extend those policies to November 17, 2026. The next step is to place renewed coverage before that date. Premiums are paid from condominium fees, which is one reason timely payment of your condominium fees matters (see section 8).
Owners in those seven corporations will receive a copy of the insurer's written email confirmation of the extension in the next few days. It is a record of the corporation and you may give it to your own broker.
The building policies for the other 20 corporations are not expiring this month. I will tell you in the coming days how to obtain the building policy or certificate for your building.
Unit-side insurance. Each owner insures their own unit. This usually covers improvements to the unit, contents, liability, loss of rental income, and any deductible the corporation may charge back to an owner.
Unit-side insurance is not in the scope of the Administrator. Owners are responsible for arranging it.
If your unit coverage was a certificate under a SIREG master policy (the rental-pool option), do not assume it is still in force. SIREG is in insolvency proceedings. Contact the broker named on your certificate now to confirm the policy is in force and the premium is paid, and ask what happens at renewal. Brokers renewing rental-pool unit policies have been asking for proof that the building policy is in force; the extension confirmation described above is that proof for the seven corporations named. If you cannot get confirmation, it is advisable to arrange your own policy. Review the building policy for your corporation once it is available so you can choose the right unit-side coverage and avoid gaps.
Tenant (occupier) insurance. Tenants are strongly encouraged to insure their own belongings. This is a matter between owners and tenants and is not in the scope of the Administrator. We are aware that some SIREG leases require tenants to carry this coverage. Owners should review their leases and determine what is right for their situation.
Once an elected board is in place, it may negotiate rates and consider group-buy offers for owners.
4. Property management
Each corporation urgently needs a property management company. This is a matter of health and safety.
Condominium management. The building's manager deals with the common elements and the corporation. It must be licensed by the Condominium Management Regulatory Authority of Ontario (CMRAO). It does not manage individual units.
Unit-side management. These services cover rent collection, condo fee remittance, tenant management and in-unit repairs. Providers do not need a CMRAO licence, although some CMRAO-licensed companies also offer these services. These services are not in the scope of the Administrator. Owners are responsible for arranging them, if they wish, and should do their own due diligence on any provider.
Expedited Request for Proposals (RFP). I have started an expedited RFP process to engage reputable licensed condominium management companies. Because the need is urgent, the timeline will be short. We expect to issue the RFP to eligible vendors early next week.
Bids will be evaluated on scalability, capability, reputation, cost and references, among other factors. Where feasible, RFPs will be grouped to create economies of scale for corporations that share common property (for example, the Kipps Lane buildings in London).
Awarded contracts are positioned for near-term coverage and will include exit clauses so that the elected board can replace or add services once things are stable.
The building's manager may offer unit-side services to owners separately. That will be an optional, non-scored item in the RFP. Bidders may choose to offer it and owners may choose to consider it.
5. Records from SIREG and the Proposal Trustee
AlixPartners is the Proposal Trustee in the SIREG insolvency proceedings (the "Trustee"). I have been in touch with SIREG and the Trustee to secure the corporations' records including, but not limited to: unit owner registers, insurance policies, declarations, by-laws, reserve fund information and financial records.
I have reviewed some of these records. Many are incomplete. I am working on a plan to obtain the rest and correct what is incomplete.
If needed, I will work with Interim Building Leads to fill the gaps. An Interim Building Lead is a unit owner in a building who has agreed to help my office by collecting documents and information from other owners in that building, with each owner's consent, and passing them to my office. Interim Building Leads have no authority to act for the corporation, to give instructions on fees or payments, or to speak for me. If I ask for Interim Building Leads in your building, I will say so in an update on antman-administrator.ca, and anything they collect will go only to my office, my appointed agent(s) and/or my lawyers.
These records are needed to prepare the owner lists for the Shadow Board elections (see section 9).
6. Vendors and utilities
My review of the financial records, and my contact with critical vendors and utilities, confirmed that many accounts were unpaid when I was appointed.
My first priority was to keep services running: heat, water and other utilities. I have contacted providers to confirm my appointment and to ask that service continue while accounts are reviewed. I am now reviewing the unpaid accounts for each corporation, including confirming which amounts belong to which corporation, and will work with providers on available options.
For many buildings I do not yet have records showing which company supplies hydro, natural gas or water, or whether the building is bulk-metered or sub-metered. If you know who supplies utilities to your building, or have an account number or bill, please send it to utilities@antman-administrator.ca.
If you or a resident receives a disconnection or service-interruption notice, send it to utilities@antman-administrator.ca with:
- the corporation name and number;
- the building address and unit number; and
- your contact information.
7. Municipal orders
Some municipalities have issued notices to certain buildings about critical repairs and by-law compliance, including an "Order to Make Safe" and "Orders for outstanding repairs".
I have reviewed and prioritized these orders. Matters affecting the safety of a building come first, followed by other by-law matters. I am working with engineers on plans to comply with them. Owners of the affected buildings will be told directly.
8. Rent and condominium fees
Tenant rents. Owners are responsible for dealing with their tenants and collecting rent. This is set out in the notices the Trustee sent out in recent weeks, and the Trustee has also advised the court of it. These matters are not in the scope of the Administrator. SIREG no longer manages any of these buildings and has no authority to collect rent or any other payment from tenants or owners. I understand the Trustee is still providing owners with existing leases and information on tenants and vacant units.
IMPORTANT: Payment of Condominium fees. Owners must pay condominium fees to their own corporation. Fees continue to be due on the first of each month, including November 1, 2026.
How much to pay? Please pay the amount for condominium fees paid on your most recent fee notice. We will account for and make necessary adjustments in due course.
New bank accounts for the 27 corporations are being opened but will likely not be ready in time to service payments by November 1.
For your November Condominium Fee remittance, fees will be collected through the trust account of my lawyers, LDDC Lawyers, and remitted to each corporation's account once it is open.
Cancel any payments to SIREG. If you have a pre-authorized debit, post-dated cheques or any other standing payment arrangement with SIREG Management Inc., The Simple Investor or any related company, cancel it now and ask your bank to place stop payments on any outstanding cheques. SIREG has no authority to collect condominium fees or any other amount from you.
Many owners had fees paid out of the SIREG rental pool and may not know whether their account is current. Any arrears from that period will be reviewed and addressed with owners in the coming weeks. You do not need to do anything about this now, and it will not affect your right to vote at the upcoming meeting (see section 9).
Where to pay, and where not to pay. Payment instructions will come only from antman-administrator.ca and from my lawyers, LDDC Lawyers. Do not send any payment to SIREG, to the Trustee, or to anyone else who contacts you about fees.
The only payment addresses are the two above and on antman-administrator.ca; anything else is not from me.
9. Shadow Boards and elections
Paragraph 8 of the October 15 Order states, in part:
"THIS COURT ORDERS that, as soon as is reasonably possible and in any event within thirty (30) days of the date of this order, the Administrator shall convene meetings of the unit owners of each of the Subject Condo Corps for the purpose of electing a "shadow" board of directors for each of the Subject Condo Corps (each a "Shadow Board" and collectively the "Shadow Boards")."
What is a Shadow Board? A Shadow Board is a board of directors elected by the owners of a corporation under the Order. While I am Administrator, the legal powers of the board stay with me. The Shadow Board works alongside me: it learns the corporation's affairs, is consulted on my decisions, and prepares to take over. When the court ends the administration for a corporation, the Shadow Board becomes its board. My aim is to make that transition as quickly as each corporation's circumstances allow. The Shadow Board does not make decisions until the court empowers it to do so. I remain accountable to the court for all decisions made on behalf of the 27 corporations until that time.
Meeting dates. The election meetings will be held by video conference on November 10, 11 and 12, 2026, in one-hour slots between 10:00 a.m. and 8:00 p.m. Each corporation will have its own meeting. The date and time for your corporation will be in the meeting notice, which will be sent by email and posted on unit doors. For the three corporations added by the October 22 Order, the 30-day period runs from October 22, so by November 21, 2026; their meetings will be scheduled in the same way.
What the meeting covers. This is an election meeting only. There will be no auditor's report, financial presentation or other business.
How to run. Nominations are open now through the form on antman-administrator.ca.
Note: This is the only official process for advance nominations recognized by the Administrator. Nominations from the floor at the meeting are subject to each corporation's by-laws.
The form confirms the eligibility requirements under the Condominium Act, 1998 and asks each candidate to complete the Condominium Authority of Ontario director training if they have not already done so.
Nomination Deadline To meet the timeline of Justice Steele's Order and to provide sufficient notice to owners, you must submit your nomination by Sunday, October 25, 2026 at 11:59 PM in order to have your name included in the meeting package.
Note: Owners who miss that deadline may be able to stand for election from the floor at the meeting, subject to their corporation's by-laws. See Standing for election from the floor.
Candidates should also check their own corporation's by-laws for any additional eligibility requirements. A copy of the corporations by-laws may be obtained for a small fee from https://onland.ca
Voting and proxies. The meeting will be hosted by an independent electronic meeting provider, which will also receive and verify proxies and act as scrutineer. Proxy forms and instructions will come with the meeting notice. Each unit has one vote. Because the arrears records inherited from SIREG are not reliable, no owner will be excluded from voting at these meetings on the basis of those records. That is a procedural decision for these meetings only; it is not a finding that any account is current.
How the election will work. My office, with my lawyers, will:
- solicit nominees through the website;
- send each corporation's owners a meeting notice via email, or where email is not in our records posted to the unit's door;
- distribute proxy forms and instructions;
- hold a virtual meeting at a stated date and time;
- document the results; and
- work with each elected Shadow Board to transition the corporation back to self-governance.
10. Keys and building access
The Trustee holds unit keys for the 27 corporations and, under the October 22 Order, is to deliver them to me. Once I have them, I will post on antman-administrator.ca where and when owners can arrange to pick up their keys.
11. Status certificates
Owners who are selling or refinancing a unit need a status certificate from the corporation under section 76 of the Act. SIREG is no longer issuing them. Until a property manager is in place, my lawyers, LDDC Lawyers, will handle status certificate requests directly.
To request a status certificate, contact LDDC Lawyers at info@lddclawyers.com with your corporation name and number, unit number and the date you need the certificate by. They will send you instructions and confirm the fee.
